European Privacy Group Files Complaints Against TikTok, AliExpress Over Data Transfers to China
TMTPOST -- Austrian privacy organization None of Your Business (noyb) has lodged formal complaints against TikTok, AliExpress, SHEIN, Temu, WeChat, and Xiaomi, accusing them of breaching European Union data protection laws by unlawfully transferring user data to China. The advocacy group is calling for an immediate halt to these data transfers, arguing that the companies cannot adequately protect user data from potential access by the Chinese government. The complaints have been submitted in Austria, Belgium, Greece, Italy, and the Netherlands. "China's status as an authoritarian surveillance state makes it abundantly clear that its data protection standards are not on par with those of the EU," said Kleanthi Sardeli, a data protection lawyer at noyb. "The transfer of Europeans' personal data is unquestionably illegal and must stop immediately." Noyb emphasized that these companies are obligated to comply with Chinese authorities' demands for data access. Furthermore, the group highlighted the absence of an independent data protection authority in China to address concerns about government surveillance.
