U.S. Treasury Proposes Wider Outbound Investment Curbs on AI
TMTPOST — The U.S. Treasury Department on October 22 released a notice of proposed rulemaking under the Comprehensive Outbound Investment National Security Act that would expand restrictions on American private investment in sensitive technologies. The proposal adds high-performance computing and supercomputing, hypersonic systems and biotechnology to the existing covered sectors of semiconductors, quantum information and artificial intelligence. It also extends “countries of concern” beyond China (including Hong Kong and Macau) to Russia, Iran, North Korea, Cuba and Venezuela under the Maduro regime. For AI systems, now referred to in related documents as superintelligence or SI systems, the draft shifts away from compute-threshold tests toward broader prohibitions on development activities by covered foreign persons. Public comments are due in early December. The rules remain proposed and would not take effect until finalized.
